Em seguida, a advogada convidada da Lacerda Diniz Advogados, Fernanda Silveira, fez uma retrospectiva das reformas tribut\u00e1rias j\u00e1 realizadas no Brasil e apresentou um panorama geral da reforma atual, destacando algumas cr\u00edticas \u00e0 organiza\u00e7\u00e3o do sistema tribut\u00e1rio brasileiro.<\/p>\n\n\n\n<p>J\u00e1 o consultor da FIEMG, Thiago Feital, destrinchou o texto do PLP 68\/2024, tratando estrutura geral do Imposto sobre Opera\u00e7\u00f5es com Bens e Servi\u00e7os (IBS) e da Contribui\u00e7\u00e3o sobre Bens e Servi\u00e7os (CBS), bem como sobre fato gerador, base de c\u00e1lculo, local de incid\u00eancia, entre outros temas presentes no texto.<\/p>\n\n\n\n<p>Feital tamb\u00e9m destacou em sua apresenta\u00e7\u00e3o alguns pontos que ainda geram d\u00favidas e que devem ser alvo de debate durante a discuss\u00e3o no Congresso Nacional. \u00c9 o caso, por exemplo, da incid\u00eancia do IBS\/CBS sobre doa\u00e7\u00e3o onerosa, sobre o qual j\u00e1 incide o ITBI, o que geraria bitributa\u00e7\u00e3o. Tamb\u00e9m h\u00e1 questionamentos sobre como ser\u00e1 aplicada a legisla\u00e7\u00e3o no que diz respeito aos bens de uso e consumo pessoal.<\/p>\n\n\n\n<p>Ainda durante o evento, \u201cDestrinchando a Reforma Tribut\u00e1ria\u201d, a analista de Assuntos Tribut\u00e1rios da FIEMG, Fl\u00e1via Sales, discorreu sobre o Imposto Seletivo, que deve incidir sobre produtos e servi\u00e7os prejudiciais \u00e0 sa\u00fade e ao meio ambiente.&nbsp; Ela explicou, no entanto, que apesar de ser destinado a bens e servi\u00e7os, o PLP 68\/2024 prev\u00ea apenas a incid\u00eancia sobre bens, sendo eles: ve\u00edculos, embarca\u00e7\u00f5es e aeronaves, produtos fum\u00edgenos, bebidas a\u00e7ucaradas, bebidas alco\u00f3licas e bens minerais extra\u00eddos.<\/p>\n\n\n\n<p>Ap\u00f3s a apresenta\u00e7\u00e3o sobre as regras gerais acerca do IBS, CBS e Imposto Seletivo, a analista de Assuntos Tribut\u00e1rios da FIEMG, Shirley Ferreira, fez uma apresenta\u00e7\u00e3o sobre os \u201cRegimes Espec\u00edficos e pr\u00f3prios do IBS e CBS, Transi\u00e7\u00e3o e Avalia\u00e7\u00e3o Quinquenal\u201d.&nbsp;<\/p>\n\n\n\n<p>Em rela\u00e7\u00e3o \u00e0 transi\u00e7\u00e3o, a lei prev\u00ea que a partir de 2026 sejam iniciados os testes com o IBS e CBS com al\u00edquotas de 0,9% e 0,1%, respectivamente. J\u00e1 em 2027, haver\u00e1 a extin\u00e7\u00e3o do PIS e Cofins e a redu\u00e7\u00e3o a zero do IPI, com exce\u00e7\u00e3o da Zona Franca de Manaus.
